In 1995, California launched the Workplace Security Program as an additional element of the employee Injury and Illness Prevention Program. Since then, workplaces have been confronting increased violence to managers, supervisors, and frontline employees. Public service sectors such as emergency services, law enforcement, health care facilities, and correctional facilities have long been a focus of threats and violence. In 2014, the Labor Code was amended to require violence prevention programs in healthcare settings. However, increased risks to the physical and mental well-being of workers are occurring in all sectors of business including service business such as community care facilities, retail, and manufacturing. From 2017 to 2022, California Occupational Safety and Health Administration (CalOSHA) proposed several regulatory drafts to address this increase in violence. However, none of these gained much traction. In 2023, California Senator Dave Cortese authored Senate Bill 553 to address escalating worker injuries and deaths, and to require that CalOSHA develop and implement a violence prevention program for all workplaces effective July 1, 2024. This program will address employer and employee responsibilities, violence prevention plan requirements, and methods to expedite inclusion of this program into a workplace Injury and Illness Prevention Plan. This program is specifically designed to meet the requirements indicated in the core of knowledge section on Law and Regulations.

Course Objectives:

Upon successful completion of this seminar, you will be able to:

  • Describe the General Duty Clause as defined in the Occupational Safety and Health Act of 1970.
  • Discuss the employer’s authority to seek a temporary restraining order.
  • Identify essential elements of the Workplace Violence Prevention Plan.
  • Discuss the Model Workplace Violence Prevention Plan.
  • Discuss methods to incorporate the Model Workplace Violence Prevention Plan into the organization’s Injury Illness and Prevention Plan.
