SESSION 1:  Independent Contractor or Employee Determination

California’s employment laws are complex, and located in several statutes and regulations. Varying definitions of an independent contractor are equally complex. Much too often, employers have paid individuals for products or services as an independent contractor, but did not correctly follow up with required California and Internal Revenue Service documentation. This program will provide Administrators with an update on California’s statutes used to define and document pay to independent contractors. This program is specifically designed to address the core of knowledge section on Law & Regulations.

Course Objectives

Upon completion of this course the participant will be able to:
• Discuss Assembly Bill 5 of 2019 as it applies to determining Independent Contractor qualifications in California.
• Discuss required documentation and filing requirements when paying individuals as an Independent Contractor.

SESSION 2: Sexual Harassment & Abusive Conduct Prevention
Course Time: 10 PM – 12 Noon (2 Contact Hours or CEs)

Despite wide-spread media attention and numerous high-profile lawsuits, sex discrimination and harassment continues to compromise the workplace. Contributing factors include a lack of clear understanding by employers, supervisors and employees alike as to what constitutes unlawful sex discrimination and harassment. Additionally, an increase in the complaints of workplace “Abusive Conduct” or “bullying” have led to new legal requirements for educating California’s employers and supervisors. Finally, newly published, legal definitions of terms related to gender identity and expression have dramatically expanded the list of protected characteristics in terms of housing, employment, and education. Understanding of these sex and gender related terms and concepts is vital toward assuring a respectful and civil workplace and living environment in the community care setting. This program is designed to meet the Core of Knowledge section on Management/Supervision of Staff.

Course Objectives

• Define sexual harassment.
• Define abusive conduct.
• Identify resources to assist in defining newly published, legal definitions of terms related to gender identity and expression.
• Describe methods to identify potentially harassing or abusive behaviors in the workplace.
• Describe methods to prevent sexual harassment or abusive conduct in the workplace.
• Describe methods to address a complaint of sexual harassment or abusive conduct.
•  Identify resources available to assist in the resolution of sexual harassment or abusive conduct complaints.

SESSION 3: Medical Waste Management Laws and Regulations for Residential Care
Course Time: 1 PM – 2:50 PM (2 Contact Hours or CEs)

Many if not most Residential and Community Care Administrators are unaware that the California Medical Waste Management Act applies to them, including a requirement to register with the California Department of Public Health. California Statute and Regulation define the rules regulating the treatment of medical waste in both health care facilities and the Residential Care and Community Care Licensed Facility. It is essential that Administrators have a working knowledge of these rules so as to ensure that specific regulations addressing the role of the direct care staff, as well as the scope of license of the Residential Care and Community Care Facility will be discussed. This program is specifically designed to meet the Core of Knowledge sections on Law and Regulations.
Upon successful completion of this course, you will be able to:
• Discuss the Medical Waste Management Act (MWMA) as it applies to the Community Care Facility and the Residential Care Facility for the Elderly.
• Identify categories of medical waste described in the MWMA.
• Describe Title 22 regulations for the Community Care Facility and the Residential Care Facility for the Elderly that provide public policy on disposal of a resident’s unused medications.
• Discuss the purpose and content of a waiver to Community Care Facility and Residential Care Facility for the Elderly regulations to allow for off-site disposal of medical waste.

 

SESSION 4: Exceptions, Waivers & Exemptions: Law & Regulations
Course Time: 3 PM – 5 PM (2 Contact Hours or CEs)

Over the years, the level of acuity has increased in all levels of the health care continuum. Health care conditions that may have required critical care or hospital care are routinely provided in skilled nursing facilities. Similarly, health care conditions that were previously prohibited in residential care are now restricted or allowable. Additionally, some incidental medical conditions that required exceptions or waivers no longer required advanced authorization by the Community Care Licensing Division. This program provides an update on Prohibited, Restricted, and Allowable Conditions. This program is specifically designed to address the Core of Knowledge section on Law and Regulations.
Upon successful completion of this seminar, participants will be able to:
• Differentiate between an exception, a waiver, and an exemption.
• Discuss the process of applying for an exception, a waiver, or an exemption.
• Describe guidelines for providing care to a resident with Restricted Health Conditions.
