Description
Although the long term care industry was rarely involved in litigation in the past, it has increasingly become a specific target for litigators and various state agencies. This presentation will provide administrators with clear and specific guidance on what constitutes the Standard of Care in various health care settings. The program will provide an update on contemporary trends in continuum of care issues and provide best practice approaches that are soundly based on the standard of care. This course will also provide long term care administrators with strategies for limiting their exposure to loss from claims and litigation while protecting their assets. Attendees will be provided with best practices on a range of options to safeguard the benefits of their labor. The content will explore various forms of estate trusts, how to utilize business structures to limit liability, the use of succession as a means of asset protection, the pros and cons of off-shore bank accounts and trusts, and the use of Chapter 11 reorganization. Armed with definitive guidance on this topic, administrators will best be able to align their practice accordingly as a best and first line of defense against litigation.
